Toxic torts include any injury caused by dangerous chemicals or other hazardous substances. Some hazardous substances are well-known, such as asbestos, lead, benzene, and beryllium. However, even products that seem safe may contain hazardous chemicals. One example is microwave popcorn flavoring containing diacetyl, a chemical that causes irreparable lung damage. Robert E. Working closely with nationally-recognized co-counsel, Robert E. Sweeney Co., LPA has also helped to recover substantial settlements on behalf of workers at a Marion, Ohio, popcorn plant, who developed irreparable lung damage from commercial butter flavorings. Popcorn flavoring can cause a disease known as bronchiolitis obliterans – an obliteration of the airways, known by the press as “popcorn-workers’ lung.” In 2003, Robert E. Sweeney Co., LPA filed the first case in Ohio involving this new area of litigation. Since that time, the firm’s popcorn-flavoring practice has continued to grow, as lung injuries at other popcorn, snack-food, and flavoring plants become known. The firm now represents hundreds of workers out of four plants in two states.
