FELA
Railroad and maritime workers who have been injured on the job may have a right to compensation under the Federal Employers’ Liability Act. “FELA,”as it is known, functions as a workers compensation system for railroad workers. Any type of serious railroad-related occupational injury might qualify for compensation under FELA. For example, Robert E. Sweeney Co., LPA has successfully handled FELA claims for railroad workers who have contracted asbestos-related illnesses.
Although the Federal Employers’ Liability Act originally applied only to railroad workers, Congress extended FELA rights to maritime workers with the passage of the Jones Act. Under the Jones Act, which applies the FELA “featherweight” standard for proving liability, maritime workers who have been injured on the job may also qualify for compensation.
Because of Ohio’s central location, railroads and ports are important to the local economy. Railroad and maritime workers are a valuable local resource, and deserve protection. If you have been injured in railroad or maritime work, please contact Robert E. Sweeney Co., LPA for a consultation.
