Complex Litigation
Descriptions of our firm frequently emphasize our work in the fields of occupational disease and environmental damage cases. These are also examples of our experience in handling complex litigation. Even on an individual case basis these cases are often much more complex than most personal injury matters. There are usually multiple defendants, and in addition to medical proofs as to what caused injury to the plaintiff, there can be multiple issues over the degree to which a particular defendant’s products may have contributed to cause the injury.
In addition to these complex evidentiary matters, such cases may also present complex procedural challenges. Our firm is well versed in handling the complexity of litigating in a class action context, and in dealing with special dockets, such as the federal court system’s referrals of certain cases to their MultiDistrict Litigation Panels (MDL dockets).
Our firm has served as lead class action counsel in consumer litigation (Hamilton v. Ohio Savings Bank, 82 Ohio St.3d 67), as well as in a mass tort setting (David Sturms v. WVU). Additionally, in past bankruptcy settings involving asbestos manufacturers we have participated in committees that assisted in the design of trust facilities that later processed claims filed by injured workers.
