A civil lawsuit can be filed to recover for damages suffered by anyone who has been the victim of an assault. The type of contact that would ordinarily warrant this type of case is when the assailant knowingly attempted and caused serious physical harm to the victim.
In addition to the obvious situations where an aggressor physically attacks the victim out of anger or with intent to rob or intimidate, this cause of action is also warranted when someone has engaged in sexual conduct without disclosing that they are a carrier of AIDS, or where they have engaged in sexual conduct with a person under the age of eighteen who is not their spouse.
Because of the egregious nature of the allegations under this type of action the law provides for a very short statute of limitations, and requires that such a lawsuit be filed within one year of the assault.
